Membership Terms and Conditions

4Ever Fit Membership Agreement
Terms & Conditions (effective date 7/1/23)

All Term memberships have a 30 day-guarantee
New Memberships have a no-risk, 30-day guarantee. As a first-time 4-Ever Fit member who has not previously had a 4Ever Fit membership or trial offer, you may terminate your agreement and receive a complete refund within 30 days of your first class or small group personal training session or personal training session. We want to be your home for health and fitness but if you're not having a good time in the first month, just let us know, and we'll help you find a better fit.

With your 1 year or your Month To Month membership, you have been allotted a specified number of classes or small group personal training sessions to be accessed every 2 weeks. During the term of your agreement, a new allocation of sessions is available for you to use every 2 weeks, starting with your auto-payment and expiring 14 days later. Your unused sessions will not carry over. Please plan accordingly.

Your Auto-Payments Occur Every 2 Weeks
You will be billed bi-weekly unless you have pre-paid your Membership. A charge of up to $25 will be made for any payment returned due to non-payment. 4Ever Fit may change membership terms and rates under this agreement by posting notice of such change at least 30 days in advance of such change.

Interaction Terms
You agree to keep and obey all rules and regulations now in force or in the future prescribed by 4Ever Fit, for the use of 4Ever Fit training facilities, premises, and equipment therein, and 4Ever Fit reserves the right to revoke this membership for cause if you fail to keep and obey any such rules and regulations, or for reasons of nuisance, disturbance of other members or staff or fraud. Without limiting your obligation to obey the rules and regulations of 4Ever Fit presently in force or in the future prescribed, you agree to obey the policies and procedures as found on the Terms and Conditions section of the 4Ever Fit website.

Need to Freeze?
We make freezing (or temporarily suspending) your membership painless. After filling out the Membership Freeze Request Form on the website under the member dashboard, please allow up to 7 business days for us to process your request. Your billing will be suspended for the duration of the 2-week freeze. The billing will automatically resume once the freeze period has ended. Any suspended payments will be added onto the initial term of your agreement, extending the Membership term by the length of the freeze. Here are the details for freezing:

1 Year Memberships: You may take advantage of up to 2 complimentary freezes during the term of your agreement. Each freeze will be for one 2-week billing cycle.

Month to Month Memberships: Month to Month agreements may freeze their membership up to once every twelve months. The freeze will be for one 2-week billing cycle, at a reduced rate of $10 per week.

Medical Freezing: Medical freezes are always complimentary if you provide a note from your doctor detailing the medical necessity of the freeze. The length of a medical freeze will be determined on a case-by-case basis.
Account Balances and Freezes: Members with an outstanding account balance may not freeze their account until balances are paid.

PLEASE NOTE: All membership freeze requests must be submitted via our Freeze Request Form at least 7 business days in advance of the freeze start date. 4Ever Fit will not be held responsible for auto payments that occur before a freeze request is processed if the request is made within 7 business days of a member's billing date.

Need to Change Your Membership?
Want to switch things up? After filling out the Membership Change Form, allow up to 7 business days for us to process your upgrade request.
1-Year Membership Changes: 4Ever Fit 1-year contract members may upgrade their 1-year membership at any time, subject to current rates. The term of the new agreement will begin again, starting with the next autopay date.
Month To Month: MTM Members can change their membership to a 1 Year membership, subject to current rates. The term of the new agreement will begin again, starting with the next autopay date. Members may not change their 1 Year membership to a Month to Month membership while under contract.

Any downgrade of MTM membership will take effect 14 days from the date of receipt of the Membership Change Form.

If You Decide to Terminate Down the Road...
We will be very sad to see you go. Notice of termination must be made by phone (715-475-1331) or in person to a 4Ever Fit staff member to complete a brief termination/exit form.  After completing the Membership Termination Form with Tony or Kim, please allow 28 days (2 payment cycles) for us to process your request.

Terminating at the End of Your Current Agreement: Your contract is set to automatically auto-renew at the end of your 1-year term so that you will have continual access to your classes and/or small group personal training sessions.  If you want to alter your membership type at the time of auto-renewal, please complete a membership change form.  If you do not wish for your agreement to auto-renew, you must fill out a termination request no later than 28 days prior to the first auto-payment of what would have been your next term.


Terminating a 1-Year Membership Early: Members early terminating a 1-year contract will incur a termination fee equal to 50% of the remaining contract fee.

Terminating a Month To Month Membership: Month To Month members may cancel after an initial period of 8 weeks. All cancellation requests must be submitted at least 28 days prior to the member's next autopay billing date. If canceling within the first 8 weeks, Month To Month will be charged a cancellation fee equal to the sum of membership dues remaining for the initial 8-week period.
Account Balances and Terminations: Members with an outstanding account balance may not terminate their account until balances are paid. "No Fee" Terminations: If you have a medical issue that prevents you from utilizing your membership, you may be allowed to terminate without penalty by providing a note from your doctor detailing the medical necessity of the termination.

Additional Details.
4Ever Fit can cancel this agreement at any time and will return any payment for unused future services. Without limiting 4Ever Fit’s ability to terminate this membership for cause, 4Ever Fit may terminate this membership for any reason at the end of any given billing cycle. If 4Ever Fit elects to so terminate, 4Ever Fit will refund a pro-rated portion of any dues applicable to future billing cycle(s).
This membership belongs to you, and you can't give it to anyone else. It is expressly understood and agreed that this agreement is not assignable or transferable by member, and no rights or privileges granted by this Membership can be transferred or assigned by member.
Any pictures, audio, or visual recordings taken of you at 4Ever Fit, in 4Ever Fit-hosted virtual classes and events or at other official 4Ever Fit events may be used for publication, promotion, articles, shows, and advertisement without additional consent and without compensation.

Liability Waiver
You are working on your health and fitness at your own risk. It is further agreed that all exercises, including the use of weights, number of repetitions, and use of any and all machinery, equipment, and apparatus designed for exercising and the use of 4Ever Fit’s premises and facilities shall be at the member’s sole risk. Notwithstanding any consultation on exercise programs which may be provided by 4Ever Fit employees or agents, it is hereby understood that the selection of exercise programs, methods and types of equipment shall be clients entire responsibility, and 4Ever Fit shall not be liable to any member or member's family for any claims, demands, injuries, damages, or actions arising due to injury to member's person or property arising out of or in connection with the use by member of the services and facilities of 4Ever Fit or the premises where the same is located.
4Ever Fit cannot be responsible for your possessions. If a member brings any personal property onto the premises of 4Ever Fit, member takes such action at member's sole risk. Member hereby holds 4Ever Fit, its successors, assigns, owners, officers, directors, employees, and agents harmless from all claims which may be brought against them by member, on member's behalf, by member's family, and member's executors, administrators, and personal representatives for any such injuries or claims aforesaid and member for himself/herself and on behalf of his/her family, executors, administrators, and personal representatives does hereby forever release and discharge 4Ever Fit, its successors, assigns, owners, officers, directors, employees, and agents from all claims, demands, injuries, damages, actions, losses and expenses. This section will survive any cancellation of this Agreement.

By checking here or acknowledging terms and conditions on a pricing purchase sheet-
o I acknowledge that my membership will auto-renew unless I complete the termination process in advance of the renewal as specified in this contract.
o I acknowledge that all Membership Freeze or Change requests must be made at least seven (7) business days in advance.
o I acknowledge that a non-covered early termination of my membership may result in a cancellation fee of 50% of my contract fee and forfeiture of all incentive offers, credits, or bonuses previously awarded for my current contract.
o I acknowledge that--if my membership is a Month To Month membership requires a minimum commitment of eight (8) weeks, after which I may terminate my membership without penalty if done at least 28 days in advance of my next membership payment.
o I have read and understand the terms of this agreement and agree to its provisions. I also understand that I am able to consult the 4Ever Fit website for terms and conditions.
o I acknowledge the agreement terms outlined above and that this is a legally binding contract.
